These Terms and Conditions govern your use of the Threshold Performance Lab website (thresholdperformancelab.com), our athlete portal, and any testing services we provide. By using the website, creating an athlete account, or booking a test, you agree to these terms.
2. Use of the website
You may use our website for personal, lawful purposes only. You must not attempt to disrupt the website, access it without authorisation, or use it in a way that infringes the rights of others.
3. Athlete portal and user accounts
- The athlete portal is provided to invited athletes only.
- You are responsible for keeping your login details secure.
- You must provide accurate, current, and complete information when creating your account and completing the intake form.
- You are responsible for the accuracy of information you provide. Test recommendations are based on this information.
4. Testing services
We provide lactate testing, INSCYD physiological analysis, performance testing, athlete reporting, community testing sessions, and remote testing services. Test protocols are determined based on your goals, sport, and intake information.
Remote testing
Remote testing relies on data and effort recorded by you on your own equipment. Results depend on the accuracy of your equipment (power meters, heart rate straps, etc.), your honest execution of the protocol, and the quality of the data submitted.
Report delivery
Reports are typically uploaded to your athlete portal within the timeframe agreed at booking. Delivery times may vary slightly during busy periods or where additional analysis is required.
5. Payment and bookings
- Bookings, payments, and follow-up scheduling are handled directly via email, phone, or calendar.
- Payment is required as agreed at the time of booking. Late payment may delay report delivery.
- Cancellations and rescheduling are handled case-by-case. Please give as much notice as possible.
6. Service availability and amendments
We may update, add, or remove services from time to time. We may also need to reschedule tests for safety, equipment, or availability reasons. We will give reasonable notice where this affects a confirmed booking.
7. Intellectual property
All content on this website — including text, images, logos, layouts, report templates, and the Threshold Performance Lab brand — is owned by or licensed to Threshold Performance Lab. You may not reproduce, redistribute, or use this content commercially without our written permission. Reports we deliver to you are for your personal training use; please ask before sharing them publicly.
8. Limitation of liability
To the maximum extent permitted by law, Threshold Performance Lab is not liable for indirect, incidental, or consequential losses arising from your use of our website, athlete portal, or testing services. Nothing in these terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Health acknowledgement
Performance testing involves physical exertion. You are responsible for ensuring you are medically fit to undertake testing and should consult an appropriately qualified healthcare professional if you have any concerns.
10. Governing law
These terms are governed by the laws of Western Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of Western Australia.
